NOOD is so confident that you will be satisfied with the quality of our products that we offer a money-back guarantee (Guarantee). This Guarantee is in addition to, and does not replace, any statutory guarantees under New Zealand law.
To be able to make a successful claim under the Guarantee, the following terms and conditions (Terms) must be adhered to.
What is the Guarantee?
- The Guarantee applies if your cat or dog does not love the NOOD pet food products you purchased for the first time.
- All valid claims will receive a refund for the price paid by you as noted in your proof of purchase, excluding any delivery, processing and handling fees (if any).
- For any Products (defined below) purchased in conjunction with a promotional giveaway, promotional giveaways must also be returned to receive the full refund on the purchased Product.
Who can claim the Guarantee?
- The Guarantee is open to residents of New Zealand who purchase any specially marked NOOD dog or cat food product (excluding treats) (Product) from Participating Stores (defined below). Claimants under the age of 18 must have parent or legal guardian approval to redeem the Guarantee.
- This Guarantee is not available for resupply or trade/commercial purchases or use, nor employees of the Promoter, its associated companies, and agencies associated with the Guarantee and their immediate families, who are all ineligible to claim.
- Participating Stores include any New World supermarket that stocks and sells the specially marked Product for retail sale. The Guarantee is not available for any Product purchased from an unauthorised seller or a seller not defined under these Terms as a ‘Participating Store’ or any NOOD pet food pack that does not contain a sticker advertising the Guarantee.
How many times can I claim the Guarantee?
- This Guarantee is limited to one claim per household.
How to claim the Guarantee
- To claim the Guarantee, you must contact the Promoter’s consumer careline at the following details [hello@noodpetfood.com or 0800 587 055] and provide the following: your personal details including your full name, contact number, valid email address, and postal address, a brief explanation of the reasons why your pet was not satisfied with the Product, a scanned copy or photo of your proof of purchase (with all details clearly visible) and your nominated PayPal email address. Claims must be made within 30 days of purchase and require proof of purchase.
- You must retain your original purchase receipt for your claim as proof of purchase. Failure to produce the proof of purchase for your claim when requested may, in the absolute discretion of the Promoter, result in invalidation of your claim and forfeiture of any right to the Guarantee. The purchase receipt must clearly specify the store of purchase.
- The Promoter reserves the right to verify the validity of all claims received and reserves the right to disqualify any claimant for tampering with the claim process. Any claim not complying with these Terms is invalid. Claimants who use multiple email addresses, residential addresses and/or aliases may be disqualified.
How and when will the claim be processed?
- Claimants must have a nominated PayPal account in order to obtain the refund.
- The refund will be deposited to your nominated PayPal account within [fourteen (14)] business days of validation of your claim. Only claimants who provide all of the required information under term 8 will be eligible for the Guarantee. The Promoter holds no responsibility if a claimant provides incorrect PayPal details and the refund is provided to an incorrect PayPal account.
Other important information
- These Terms do not exclude or limit the application of any statutory provision (including a provision of the Consumer Guarantees Act 1993 and/or Fair Trading Act 1986) where to do so would contravene that statute or cause any part of these Terms to be void.
- The Promoter is not responsible for any delayed or misdirected, or illegible claims.
- To the extent permitted by law, the Promoter may vary, revoke, or replace the Guarantee and these Terms at any time in its sole discretion and without notice.
- If there is a dispute as to the identity of a claimant, the Promoter reserves the right, in its sole discretion, to determine the identity of the claimant.
- The Promoter’s decision is final and no correspondence will be entered into.
- Each claim becomes the property of the Promoter. All details will be held in accordance with the Promoter’s Privacy Policy which can be accessed by visiting https://noodpetfood.com/en-nz/pages/privacy-policy.
- The Promoter and its associated agencies and companies will not be liable for any loss (including, without limitation, indirect, special or consequential loss or loss of profits), expense, damage, personal injury or death which is suffered or sustained (whether or not arising from any person’s negligible or wilful misconduct) in connection with the Guarantee, except for any liability which cannot be excluded by law (in which case that liability is limited to the minimum allowable by law).
- Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of these rights.
- The Guarantee and these Terms are governed by New Zealand law.
